Filing a Chapter 13 in Texas
Comencement of Chapter 13 Plan Payments
Unless you are self employed, your monthly Chapter 13 plan payments will be taken out of your wages or salary directly. This means the payroll department of your place of employment will be notified of the fact that you have filed Chapter 13 bankruptcy.
Your employer will send the monthly plan payments to the Chapter 13 Trustee, who, according to the terms of your proposed plan, will pay your creditors a share of that monthly plan payment. Creditors, depensing on their classification, may end up getting fully paid, geting paid a percentage of the amount they are owed or getting nothing at all.
Your first Chapter 13 plan payment is due 30 days after your case is filed with the bankruptcy court.
