Chapter 13
Confirmation Hearing
The bankruptcy court will hold a hearing to determine whether it should approve your proposed Chapter 13 plan. In making its determination, the bankruptcy court will consider the treatment given each creditor under your plan as well as whether you have the ability to pay the necessary plan payments. Once the bankruptcy court is satisfied that your plan meets the requirements of the Bankruptcy Code, then, it will “confirm” or approve your plan.
The confirmation hearing will take place between 20 to 45 days after the Meeting of Creditors. Depending on the facts of your case, you may or may not need to appear at the Confirmation Hearing. We will notify you in writing if your presence and participation is required.
